Terms of Service

These Terms are an agreement between you and Guide U Inc and govern your use of Orbit, the AI marketing operating system at orbitnow.io (the "Service"). By creating an account or using the Service you agree to these Terms.

1. The Service

Orbit generates marketing content, schedules and publishes posts, creates and manages advertising campaigns, and takes automated optimization actions on platforms you connect, within guardrails you configure. AI-driven actions are logged and can be reviewed, approved, declined, or reversed from your dashboard.

2. Your account

  • You must provide accurate information and keep your credentials secure.
  • You are responsible for activity under your account.
  • You must have the authority to connect any business accounts you connect.

3. Automated actions & guardrails

You authorize Orbit to act on your connected accounts within the budgets, thresholds, and rules you configure in Settings. You are responsible for reviewing guardrails and for content published with auto-publish enabled. Actions exceeding your configured thresholds require your explicit approval.

4. AI-generated content

AI-generated content may contain errors or inaccuracies. You are responsible for content published to your channels and for ensuring it complies with applicable law and platform policies. To the extent permitted, we assign to you all our rights in content the Service generates for you.

5. Acceptable use

  • No unlawful, deceptive, or infringing content or campaigns.
  • No spam, platform-policy circumvention, or artificial engagement schemes.
  • No attempts to breach, overload, or reverse-engineer the Service.
  • No use of the Service to violate the terms of connected platforms.

6. Third-party platforms

The Service depends on third-party platform APIs (e.g. Meta, Google Ads, YouTube, LinkedIn, TikTok) that may change, rate-limit, or revoke access at any time. We are not responsible for platform decisions, including ad disapprovals, account restrictions, or content removal. Features that upload to YouTube use YouTube API Services; by using them you also agree to the YouTube Terms of Service.

7. Fees

Paid plans, prices, and included usage are described at purchase. Fees are billed in advance and are non-refundable except as required by law. Advertising spend on connected platforms is billed to you directly by those platforms and is separate from Orbit fees.

8. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee marketing outcomes, including reach, engagement, conversions, or return on ad spend.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of the Service is limited to the fees you paid us in the twelve months before the claim. We are not liable for indirect, incidental, or consequential damages, or for advertising spend incurred on connected platforms.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms. Upon termination, automated actions stop and platform connections are revoked.

11. Changes

We may update these Terms; material changes will be notified by email or in-product notice. Continued use after changes take effect constitutes acceptance.
